1. Register And Receive Voucher

1. This is a promotional offer (the “Offer”) as defined in the Consumer Protection Act no. 68 of 2008 (CPA), as amended from time to time. These Terms and Conditions will govern the redemption on your Voucher from Everyshop (the “Company”) or any Company to whom the Company has ceded the rights and obligations.

2. This Voucher (the “Offer”) is promoted by Everyshop a division of JD Consumer Electronics and Appliances (Pty) Ltd (Reg No. 1963/002315/07), a subsidiary of Pepkor Trading (Pty) Ltd (Reg. No. 1958/003362/07) and with Everyshop, being a brand of the JD Group (the “Promoter”).

3. The Offer and redemption:

3.1. The participant shall have a 14 (fourteen) days grace period calculated from the redemption date in which to take up the voucher offer, after which the offer shall expire. The discount offer will be valid for 30 (thirty) days from date of redemption issued to the participant.

3.2. The participant must produce proof of identification, proof of purchase and this Voucher Certificate on redemption.

3.3. The redemption is subject to the verification of the identification of the article, which must be without any material alteration/s or modification/s to the article that is subject to the voucher.

3.4. This Offer is open to all South African Citizens and Residents above the age of 18, who are in possession of a valid identity document or passport. Employees, agents or consultants of or any other person who directly or indirectly controls or is controlled by the Company in respect of this Offer or the spouses, life partners or immediate family members cannot redeem the Voucher.

3.5. If the Company has not strictly enforced these Ts & Cs, the participant may not assume Ts & Cs been waived or altered by the Company. These Ts & Cs will still apply and the Company has right to enforce any of these Ts & Cs.

4. By purchasing, redeeming or attempting to redeem a voucher, you accept and agree to be bound by these Voucher Terms & Conditions and acknowledge you have read and understood these Voucher Terms & Conditions.

5. This Voucher can be redeemed online at www.everyshop.co.za only.

6. Vouchers are issued at the discretion of Everyshop if the criteria are met.

7. Vouchers are non-refundable and cannot be exchanged for cash.

8. Vouchers may not be used in conjunction with any other reward, voucher or discount.

9. Vouchers are not available with purchase of 3rd party vouchers or gift cards.

10. Vouchers are issued with specific terms and conditions that regulate how and when they can be used. For example, a voucher may only be redeemed for the purchasing of an item over a certain value during a specific validity period.

11. Vouchers are limited to the first 10 000 participants and only for the promotional period, which ever expires first.

12. Only one voucher can be used per purchase.

13. The onus is on the customer to check the full voucher Ts & Cs issued with the voucher and to ensure they understand the voucher’s applications and limitations.

14. Any fraudulent or abusive behaviour, not limited to the creation of multiple Everyshop accounts, in order to benefit unduly from a voucher, is abuse of the benefit and Everyshop reserves the right to deactivate a customer’s account; to cancel and not to honour any related purchases.

15. The voucher is for use on a single customer’s first purchase from the store. We reserve the right to request the customer’s ID number to verify their identity, and may cancel the order if it’s found that the voucher has been used more than once by the same customer. The customer will be fully refunded in this case.

16. Purchase authorisation will be declined if these terms and conditions are breached.

17. A voucher can be applied to any item, and the discount value of the voucher will be deducted from the total purchase price value of item/s. If the total value of your purchase exceeds the value of the voucher used, the balance is required to be paid by you. Any outstanding difference between the voucher and the amount of the purchase price must be paid before the expiry date of the quotation provided.

18. If the full value of your voucher is not utilised on your first purchase, the balance will be remaining on your voucher and this can be used for future purchases provided the voucher is still within the validity period. Using part of the voucher will not change the original voucher validity period.

19. Any balance that remains on the voucher after the voucher validity period has ended will no longer be available for use.

20. Vouchers are no longer redeemable after the voucher validity period has ended and as such will no longer be available for use.

21. Additional values cannot be added to existing vouchers.

22. In the event a purchase is cancelled by the customer after voucher redemption, the discounted voucher amount will not be reallocated or refunded and the voucher will be forfeit in its entirety.

23. Everyshop reserves the right to amend these voucher Terms and Conditions at any time.

24. Changes to the Voucher Terms & Conditions will be available on the www.everyshop.co.za in this regard the onus is on the customer to visit the www.everyshop.co.za website regularly to check whether the Voucher Terms & Conditions have changed.

11. Winning draw and Winner’s Rights and Obligations

11.1 The Winners will be chosen randomly under the supervision of an independent accountant, registered auditor or attorney.

11.2 The draw will take place on 1 September 2021. The winner will be posted and notified via a phone call. The winners will be contacted by head office and posted on the Everyshop social platforms.

11.3 Should the Competition draw be postponed, a decision which will be in the sole discretion of the Promoter, to another date for any reason whatsoever, the new draw date will be published on the website cited below within 4 (four) days after the original draw date.

4. Competition Period

The Competition runs from 22 March 2022 to the 26 April 2022, both dates inclusive. (the “Competition Period”). No entries will be accepted after midnight on 26 April 2022.

5. Who Can Enter (the “Participant”)

You are entitled to participate in this Competition if you are a natural person, 18 (eighteen) years or older, who is either a South African citizen or carries a valid work permit. The Promoter reserves the right, at any time, to verify the validity of a Participant (including but not limited to a participant’s identity and age) and to reject any Participant who has not complied with these Terms and Conditions. Errors and omissions may be accepted at the Promoter’s sole discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

6. Exclusions

Directors, members, employees, agents of, or consultants to the Promoter and its subsidiaries, their promotional partners and printers, their advertising and promotional agencies, supplier of goods or services in connection with this Competition, or if you are any of the aforementioned persons' immediate family, including spouses, life partners, parents, children and siblings, are excluded from being entered into this Competition.

7. How to Enter

7.1. A Participant must visit any Everyshop social media pages, on Facebook and/or Instagram @everyshopza, for weekly clues which will be posted on the aforementioned social media platforms;

7.2. Weekly clues will allude to a product shape which the Participant must search for on our website www.everyshop.co.za under Everyshop’s Birthday Promotion Deals;

7.3. The alluded product will also have a hidden “easter egg” in the form of a number 1;

7.4. Once the number 1 is found, the Participant must go back to the clue post and comment on either Facebook or Instagram @evershopza with the name and the brand of the alluded product to be entered into the draw to stand a chance to win the product/s of the week.

It is within the Promoter’s sole discretion to disqualify any Participant who posts any inappropriate comment or uses inappropriate language on social media platforms or webpage. In addition, social media platforms Terms and Conditions apply.

There is no entry fee to participate in the Competition.

11. Draw details and Winner’s Rights and Obligations

11.1. The Winners will be chosen randomly under the supervision of an independent accountant, registered auditor or attorney.

11.2 The random entry drawn will be independently audited by an independent accountant, registered auditor or attorney to establish whether it meets the Competition qualifying criteria and if so that the Participant will be the Winner (subject to the Promoter being able to contact the Winner). If the qualifying criteria is not met, further random draws will take place until a randomly selected valid entry meets the eligibility criteria.

11.3 The draw will take place weekly on the following dates; 28th March, 4 April, 11 April, 18 April, 25 April and 2 May 2022. In addition, the Winner will be notified via phone and may be posted on our Facebook and Instagram webpage.

11.4 Should the Competition draw be postponed, only the Promoter has the discretion to elect a new date which will be published on our website www.everyshop.co.za within 4 (four) days after the original draw date.

11.5 The Winner will be notified within 48 (forty-eight) hours of the random draw taking place. The Promoter will attempt contact the Winner at least 3 (three) times, but if the Promoter is unable to contact the Winner within 2 (two) days after the first attempt, through no fault of the Promoter, the Prize will be awarded to the next eligible Winner. The Winner may also be announced on the Promoter’s Facebook, Twitter and Instagram page or webpage only once the Promoter has made successful contact with the Winner.

11.6 If the Winner(s) is unable to attend, receive or utilise the prize or is uncontactable during the stipulated period, the entire prize shall be forfeited at the discretion of the Promoter.

11.7 The Winner gives consent to participate in marketing activities, including having his/her photograph taken and published on the Promoter’s website or other media.

11.8 The Prize is exclusively for the benefit of the Winner and is neither transferable nor exchangeable for cash or otherwise. The Prize must be taken up within 3 (three) weeks after the Winner has been notified and announced on the various social media platforms listed.

11.9 The Winner will be required to complete a declaration acknowledging receipt of the prize and that he/she is not connected to the Promoter as stipulated in clause 6 above.

11.10 By entering into the Competition, a Participant consents to the Promoter sending marketing material during and after this Competition and voluntarily provides their personal information in accordance with the Protection of Personal Information Act (“POPIA”) to the Promoter, its associated agencies and the third party service providers running the Competition in conjunction with the Promoter. 11.11 The Winner agrees that upon winning the Prize, no further prizes in any Competitions or give-away or similar campaign of Promoter. This is for a period of 3 (three) months, irrespective of whether the Winner has entered or qualified prior to or after the date on which the Prize was awarded to the Winner..

11.12 By participating in this Competition, a Participant agrees to all the Competition Rules set out above, without exception.

12. General

12.1. The Promoter reserves the right to amend, modify, cancel or withdraw any aspect of this Competition in its sole discretion at any time without prior notice or liability. The Promoter cannot guarantee the performance of any third party and shall not be liable for any act or default by a third party. Participants of this Competition agree that the Promoter will, subject to prevailing law, have no liability whatsoever for any injuries, losses, costs, damage or disappointment of any kind resulting in whole or in part, directly or indirectly from acceptance, misuse or use of the Prize, or from participation in this Competition.

12.2. The laws of the Republic of South Africa govern this Competition. If any provision or part of these Competition Rules is deemed void or otherwise unenforceable in law, then that provision or part shall be deemed excluded and the remainder of these Competition Rules shall remain in force. Any violation of these Competition Rules will result in the immediate disqualification of the transgressing Participant from the Competition.

12.3. The Promoters decision is final, and no correspondence will be entered into.

12.4. No liability shall lie on the Promoter in favour of any Participant, Winner (s) and/or third party arising from cancellation, suspension or termination. Therefore, the Participant waives any and all rights which they may have against the Promoter and hereby acknowledges that they will have no right of recourse or claim of any nature whatsoever against the Promoter.

16. Nespresso Promotion Redemption

1. This is a Promotional offer (the “Offer”) as defined in the Consumer Protection Act no. 68 of 2008 (CPA), as amended from time to time.

2. These Terms and Conditions will govern the redemption of your Voucher from https://za.buynespresso.com/ (the “Company”) or any Company to whom the Company has ceded the rights and obligations.

4.1. The R500 FREE Coffee Voucher applies only to Nespresso® coffee machine(s) purchased from participating retailers in South Africa from 1 February to 31 December 2022 (inclusive) as reflected on your original proof of purchase in the form of a till slip or similar docket issued by the retailer (copies of debit card or credit card receipts will not be accepted).

4.2. The R500 FREE Coffee Voucher is redeemable online at za.buynespresso.com, through the Nespresso® Club on 0800 63 7773 or by visiting any Nespresso® Boutique or Booth.

4.3. The R500 FREE Coffee Voucher is redeemable within 30 days from date of issue, only upon registration of the machine to which it applies, completion of the registration details required on the online form or submission of the machine pack hanging tag with the 19-digit alphanumeric barcode and validation of machine registration by Nespresso®.

4.4. This Offer is open to all South African Citizens and Residents above the age of 18, who are in possession of a valid identity document or passport.

4.6. Registration will not be validated without a valid original proof of purchase showing the machine model, machine serial number, date of purchase and name of the retailer.

4.7. Nespresso® is not responsible for the loss/damage/expiry of this Coffee Voucher and will not replace Coffee Vouchers that have expired.

4.8. The R500 FREE Coffee Voucher is linked to the individual Nespresso® machine purchased and may only be redeemed once.

4.9. The whole part of the R500 FREE Coffee Voucher must be redeemed on one occasion. No part of the R500 FREE Coffee Voucher may be redeemed as cash or converted to a credit on account for future use or exchanged for another product.

4.10. The R500 FREE Coffee Voucher value is inclusive of VAT and redeemable in South Africa only.

4.11. R500 FREE Coffee Voucher is not valid for Wholesale, Professional and Business partners within the business-to-business and HORECA markets, or for the purchase of machines for resale.

4.12. If the Company has not strictly enforced these Terms and Conditions, the participant may not assume the Terms and Conditions have been waived or altered by the Company. These Terms and Conditions will still apply and the Company has the right to enforce any of these Terms and Conditions.

Nespresso® collects the customer’s personal information in order to conduct the Offer. The Promoter may, for an indefinite period unless otherwise required by law, use the information for promotional, marketing and publicity purposes including but not limited to sending electronic messages to the Participants. 16. Purchase authorisation will be declined if these Terms and Conditions are breached.

A voucher can be applied only to Nespresso® coffee machine(s) purchased from Everyshop in South Africa from 1 February to 31 December 2022 (inclusive) as reflected on your original proof of purchase in the form of a till slip or similar docket issued by the retailer (copies of debit card or credit card receipts will not be accepted).

18. If the full value of your voucher is not utilised on your first purchase, the balance will be remaining on your voucher and this can be used for future purchases provided the voucher is still within the validity period. Using part of the voucher will not change the original voucher validity period.

19. Any balance that remains on the voucher after the voucher validity period has ended will no longer be available for use.

20. Vouchers are no longer redeemable after the voucher validity period has ended.

21. Additional values cannot be added to existing vouchers.

22. In the event a purchase is cancelled by the Participant after voucher redemption, the discounted voucher amount will not be reallocated or refunded and the voucher will be forfeited in its entirety.

19. Defy Competition Terms And Conditions

Definitions

Unless the context provides otherwise, the words and expressions set out below will have the following meanings and cognate expressions shall have corresponding meanings:

  1. “Competition” means the promotion listed in Clause 1 of the Schedule, organized by the Promoter and open all people residing in the Republic of South Africa.
  2. “Competition Period” means the period set out in Clause 2 of the Schedule.
  3. Goods” means the goods set out in Clause 3 of the Schedule.
  4. “Participant” means a person who enters the Competition.
  5. “Participating Stores” mean retailers of the Goods in the Republic of South Africa which are approved by the Promoter to participate in the Competition.
  6. “Promoter” means Reckitt Benckiser South Africa Proprietary Limited (Registration Number: 1970/014554/07) a company duly incorporated in accordance with the company laws of the Republic of South Africa.
  7. “Prize” means the prize set out in Clause 4 of the Schedule.

 

Application of Terms and Conditions

By choosing to enter the Competition, the Participant agrees to be bound by the following terms and conditions, which the Participant acknowledges to have read and understood.

1. Entry Requirements

1. In order to be eligible for Participation in this Competition an entrant must:

1.1. Be a South African citizen or permanent resident over the age of 18 (eighteen) years.

1.2. Successfully enter the Competition in accordance with the entry mechanism set out in clause 5 of the Schedule

1.3. Agree to permit the Promoter to collect his/her personal information for the purpose of the Competition and the Promoter's product marketing and development; and

1.4. Undertake to abide by these Rules.

2. Participants may only enter this Competition through the mechanic set out in Clause 5 of the Schedule.

3. Entries via any other mechanic other than that in Clause 5 of the Schedule shall not be considered.

4. Only entries received within the Competition Period will be considered. The Competition closes at midnight on the Closing Date as specified in Clause 2 of the Schedule (the “Closing Date”) and no other entries thereafter shall be considered.

2. Award Terms

1. The Prize winners shall be determined via random draw.

2. Any Prize not taken up for any reason within two months of notification will be forfeited.

3. All winners will be required to provide their names and contact details and to sign an acknowledgment of receipt of the prize.

4. In the event that the Prize winner cannot be successfully contacted within 24 hours of the final decision or is unable, for any reason whatsoever, to accept the prize, a replacement winner will be randomly drawn from the remaining qualifying participants in the draw in accordance with same process and procedures as applicable to the original draw.

3. Use of Personal Information

1. Personal information is information relating to a Participant. Personal information includes a Participant’s identity number, passport number and contact details as well as any photograph (if applicable).

2. This information may be collected by the Promoter or its agency on behalf of the Promoter for the purpose of this Competition such as but not limited to Competition draw, contacting any participant’s, finalists and/or winner/s, announcing any finalists and/or winner/s.

3. At all times, any personal information shall be transferred to the Promoter in accordance with the law of the Republic of South Africa implement security measures in accordance with applicable laws to safeguard the Participant’s personal information.

4. By entering this Competition and providing the required information, a Participant agrees that the Promoter and/or its agent may use his/her personal information in connection with the Competition. Save for personal information that the Promoter is required or authorized by law to collect, the provision of such personal information is voluntary, but should the Participant not provide all the required information then s/he may not be able to participate in the Competition.

5. As far as the law allows, each Participant agrees and gives the Promoter and/or its agent permission to collect, get, receive, record, organise, collate, store, update, use and share all of his/her personal information for all purposes relating to the Competition. The Participant also agrees to the Promoter sharing the personal information with third parties for the purposes set out above. Furthermore, the Participant understands and agrees that his/her personal information may be transferred to and accessed from locations outside South Africa, and the Participant hereby agrees to the transfer of personal information to locations outside South Africa for the purposes set out above.

6. A Participant may ask the Promoter at any time to correct or confirm any personal information if it is wrong or out of date. At all material times hereto, the personal information processed by RB will be managed in terms of its Privacy Notice, which is available at www.reckitt.com/privacy-policy/.

7. Each Participant warrants that he/she has the authority to allow the Promoter to use his/her personal information for purposes of the Competition. The Promoters will not use any Participant’s personal information in any way which breaks the law and undertakes to keep all personal information of Participants secure and for as long as the law requires.

The Participant agrees that any photographs taken of them in relation to this Competition become the property of the Promoter to use in any marketing campaigns as the Promoter deems fit and the Participant hereby consents to the usage of his/her photograph and/or full names to be used in any marketing campaigns and/or Competition announcements. The Participant shall have no claim for any compensation for use of the photograph.

9. The Promoters will require the winners to complete and submit an information disclosure agreement and indemnification to enable the Promoters to ensure compliance with these terms and conditions, as well as with the Consumer Protection Act. 4. Warranties and Indemnities

The Promoter, its employees, officers, directors, agents and associates and the Participating Stores, their employees, officers, directors, agents and associates (the “Indemnified Parties”) shall not be liable for and the Participants hereby indemnify and hold the Indemnified Parties harmless from any claim, liability, cost, expense or penalty suffered or incurred by any person as a result of participating in the Competition.

2. All products given as part of the Prizes are subject to all applicable warranties, guarantees and instructions of use accompanying such products.

5. Force Majeure

In the event of any act of God, strike, war, warlike operation, rebellion, riot, civil commotion, lockout, combination of workmen, interference of trade unions, suspension of labour, fire, accident, or (without regard to the foregoing enumeration) of any circumstances arising or action taken beyond or outside the reasonable control of the Promoter preventing them from the performance of any obligation to a Participant (any such event hereinafter called "Force Majeure") then the Promoter shall be relieved of all such obligations to the Participant during the period that such Force Majeure continues and shall not be liable for any delay or failure in the performance of any obligations or loss or damage which the Participant may suffer due to or resulting from the Force Majeure.

6. General

1. The Promoter may in its sole and absolute discretion amend these terms and conditions at any time, by publishing the revised terms and conditions on the website in Clause 6 of the Schedule.

11. The use of a voucher may also be limited by the total discount value available to all users for the Competition of a specific voucher.

12. All vouchers are valid for a period of three years after the date on which it was issued, or at the end of a longer or extended period agreed by the supplier at any time.

13. Only one voucher can be used per purchase.

14. The onus is on the Winner to check the full voucher Terms and Conditions issued with the voucher and to ensure they understand the voucher’s applications and limitations.

15. Any fraudulent or abusive behaviour, not limited to the creation of multiple Everyshop accounts, in order to benefit unduly from a voucher, is abuse of the benefit and Everyshop reserves the right to deactivate a customer’s account; to cancel and not to honour any related purchases.

16. Purchase authorisation will be declined if these Terms and Conditions are breached.

17. A voucher can be applied to any item, and the discount value of the voucher will be deducted from the total purchase price value of item/s. If the total value of your purchase exceeds the value of the voucher used, the balance is required to be paid by you.

18. If the full value of your voucher is not utilised on your first purchase, the balance will be remaining on your voucher and this can be used for future purchases provided the voucher is still within the validity period. Using part of the voucher will not change the original voucher validity period.

19. Any balance that remains on the voucher after the voucher validity period has ended will no longer be available for use.

20. Vouchers are no longer redeemable after the voucher validity period has ended.

21. Additional values cannot be added to existing vouchers.

22. In the event a purchase is cancelled by the Winner after voucher redemption, the discounted voucher amount will not be reallocated or refunded and the voucher will be forfeited in its entirety.

11.5. The Winner will be notified within 48 (forty-eight) hours of the random draw taking place. The Promoter will attempt to contact the Winner at least 3 (three) times, but if the Promoter is unable to contact the Winner within 2 (two) days after the third attempt, through no fault of the Promoter, the Prize will be awarded to the next eligible Winner. The Winner will also be announced on the Promoter’s web page only once the Promoter has made successful contact with the Winner.

11.6. If the Winner(s) is unable to attend, receive or utilize the prize or is uncontactable during the stipulated period, the entire prize will be forfeited at the discretion of the Promoter.
